Terms and Conditions

This contractual document will govern the General Terms and Conditions for contracting vehicle rental and transfer services (hereinafter, «Conditions») through the website ibizarentalcarsandsuvs.com, owned by IBIZA TRANSIT EXPRESS SL under the trademark IBIZA RENTAL CARS AND SUVS, hereinafter PROVIDER, whose contact details also appear in the Legal Notice.

These Conditions will remain published on the website at the disposal of the USER to reproduce them and keep them as confirmation of the contract, and may be modified at any time by the PROVIDER without affecting the terms implemented prior to the modification. Accepting this document implies that the USER has read, understands and comprehends what is set out herein, is a person with sufficient capacity to enter into contract, and assumes all the obligations set forth herein.

1. General Rental Conditions & Compliance

By confirming a booking, the renter agrees to these Terms & Conditions. The renter must meet all age, license, and payment requirements at the time of vehicle collection. Vehicles are strictly limited to circulation on the island of Ibiza. Transport to Formentera or the mainland is forbidden without written consent.

Mandatory Equipment: Vehicles are equipped with a V-16 Emergency Beacon, high-visibility vests, and official documentation. The Renter is liable for the replacement cost of any missing equipment.

2. Financials, Deposits & Payment Fees

Full payment is required in advance. A refundable security deposit is blocked on the Renter’s card at pickup. If charges (repairs, fines, refueling) exceed the initial deposit, the client is legally bound to pay the total difference immediately.

Accepted payment methods: credit/debit card and PayPal, processed through our booking platform (Flit2Go). The website uses generally accepted industry information security techniques (SSL, access control procedures) to prevent unauthorised access to data. There are no shipping costs, as this is the provision of a service rather than the physical delivery of a product.

3. Fuel & Misfueling Policy

Full-to-Full policy. Missing fuel is charged at €2.50 per liter plus the refueling service fee. Renter must refuel within 10 km of the return location and leave the physical gas station receipt inside the vehicle.

4. Prohibitions & Breach

Driving off-road, on forest tracks, in maritime zones, or on unpaved roads is strictly prohibited. Driving under the influence of alcohol or drugs voids all insurance. Use for race events (unauthorized transport) is forbidden. Providing false identity/address nullifies the contract.

5. Security & Theft

The vehicle must remain ALWAYS LOCKED when unattended. If found open, the Company may withdraw the car immediately. In case of theft, the contract cancels and Renter is liable for the full value of the vehicle. Insurance never covers belongings inside.

6. Return & Late Fees

60 minute grace period. 30m – 1hr 25% of daily rate; 1hr+ full daily charge. If a late return forces a category upgrade for the next client, the Renter pays the price difference.

7. Contracting Procedure, Price and Validity of the Offer

In order to access the services offered by the PROVIDER, the USER must be an adult and must freely and voluntarily provide the personal and booking data requested through the website or the embedded booking widget, processed in accordance with our Privacy Policy. The contracting procedure follows these steps: selecting the vehicle and dates, completing the driver’s details, selecting the payment method and placing the order. Once the order has been processed, a confirmation email is sent to the USER.

The prices indicated for each service include Value Added Tax (VAT) and are shown in EUR. The USER can check online all the details of the quote (vehicle, dates, price, extras, taxes and total) before confirming the booking. Prices may change while the order has not been placed; once the booking has been confirmed, the price will be maintained.

When the USER identifies errors in the data published on the website or in their booking, they may notify [email protected] so that the PROVIDER can correct them as soon as possible.

Within a maximum of 24 hours, on working days, an email will be sent to the USER confirming the status of the order and the approximate date of service provision.

In the event of not being able to execute the contract because the contracted service is not available within the planned timeframe, the USER will be informed of the lack of availability and will be entitled to cancel the order and receive a refund of the total amount paid at no cost, and without any liability for damages attributable to the PROVIDER. In the event of unjustified delay by the PROVIDER with respect to the refund of the total amount, the USER may claim payment of double the amount due, without prejudice to their right to be compensated for damages suffered beyond that amount.

8. Right of Withdrawal

The USER has a period of fourteen (14) calendar days, counted from the day following the conclusion of the service contract, to exercise the right of withdrawal regulated in article 102 and following of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws (RDL 1/2007).

To exercise this right, the USER must notify the PROVIDER of the decision to withdraw from the contract by means of a clear statement, using the Right of Withdrawal Form, sent to [email protected] or by post to Ctra. Aeropuerto, KM 4,5 — 07817 Sant Jordi de Ses Salines, Balearic Islands, Spain, indicating the corresponding booking or invoice number.

Where the booking corresponds to a service tied to a specific date or period of performance (e.g. a vehicle reserved for specific rental dates), the right of withdrawal may not apply once that period has begun, in accordance with the exceptions listed in article 103 RDL 1/2007. The PROVIDER will inform the USER of the applicable term at the time of booking.

9. Guarantees, Refunds & Force Majeure

Guarantees and refunds relating to the security deposit are regulated in section 2 (Financials, Deposits & Payment Fees) of these Conditions, without prejudice to the rights afforded to the USER under Royal Legislative Decree 1/2007.

The parties shall not be liable for any breach due to force majeure (natural disasters, strikes, administrative mobility restrictions or other circumstances beyond their reasonable control); performance of the obligation shall be delayed until the force majeure event ends. If, due to force majeure, the PROVIDER is unable to provide the contracted service, the USER will be informed and will receive a full refund of the amount paid or be offered a new date, at the USER’s choice.

10. Claims / Complaints

IBIZA TRANSIT EXPRESS SL informs that it has Complaint Sheets available to users or consumers who request them, in compliance with the regulations of the Balearic Islands. You can access them by requesting them through any of the contact details below. Any claim that the user or consumer considers appropriate to make will be attended to as soon as possible, in any of the following ways:

If you consider that the processing of your data or the service provided does not comply with current legislation, you may also file a complaint with the Consumer Affairs authority of the Balearic Islands or, for data-protection matters, with the Spanish Data Protection Agency (www.aepd.es).

11. Suspension, Severability and Jurisdiction

The PROVIDER may, without prior notice, suspend or terminate the USER’s access to its services, in whole or in part, when the USER fails to comply with any of the obligations set forth in this document or any applicable legal provision.

If any provision of these Conditions is considered null or impossible to fulfil, the validity, legality and fulfilment of the remaining provisions shall not be affected or modified in any way.

These Conditions are governed by Spanish law. Disputes shall be submitted to the courts and tribunals of Eivissa (Ibiza), or those otherwise applicable under mandatory consumer protection legislation.
